David Weinstock, an individual sole proprietor doing business in his personal capacity ("we," "us," or "our"), respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy describes how we collect, use, store, share, and protect personal information in connection with the website located at davidweinstock.com and any related content, newsletters, downloads, paid offerings, booking tools, and other features made available through it (collectively, the "Site").

The Site is owned and operated solely by David Weinstock in his personal capacity. The Site is not owned, operated, sponsored, endorsed by, or affiliated with David Weinstock’s current or any prior or future employer or any organization in which he holds or has held a position, equity interest, or other affiliation. All content, views, opinions, statements, recommendations, and materials published on or made available through the Site are the personal views and work product of David Weinstock and do not represent the views, positions, policies, or opinions of any such employer or affiliated organization. This information is collected primarily through Squarespace Analytics, our website hosting and analytics provider. Squarespace may set its own cookies and process this data in accordance with its privacy and cookie policies, which we encourage you to review.

3.3 Information from Third-Party Platforms

We may receive information about you from third-party platforms when you interact with us through those platforms, including Calendly (booking and meeting data), Stripe (transaction confirmations and limited payment metadata), and Squarespace (subscription and form-submission data). The information we receive is governed by your settings and the privacy practices of those third parties.

  • To comply with legal obligations and to establish, exercise, or defend legal rights;

  • For any other purpose disclosed at the time of collection or with your consent.

5. Lawful Bases for Processing (EEA, UK, and Switzerland)

If you are located in the European Economic Area, the United Kingdom, or Switzerland, we process your personal information on the following lawful bases under the EU General Data Protection Regulation, the UK General Data Protection Regulation, and equivalent Swiss law:

(a) Performance of a contract: where processing is necessary to deliver a paid offering, fulfill a booking, deliver a download, or otherwise perform a contract you have entered into with us;

(b) Legitimate interests: where processing is necessary for our legitimate interests, including operating, securing, and improving the Site, communicating with you about content you may find of interest, and protecting against fraud and abuse, except where overridden by your rights and interests;

(c) Consent: where you have given us specific, freely given, informed, and unambiguous consent, including for non-essential cookies, marketing communications where required, and any other processing for which consent is the lawful basis. You may withdraw consent at any time without affecting the lawfulness of processing carried out before withdrawal;

(d) Legal obligation: where processing is necessary to comply with a legal obligation to which we are subject.

6. How We Share Your Information

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We share personal information only in the following limited circumstances:

6.1 Service Providers and Processors

We share personal information with trusted service providers who process information on our behalf and under contractual confidentiality and data protection obligations. These currently include Squarespace (website hosting, analytics, and newsletter delivery), Stripe (payment processing), and Calendly (meeting scheduling). Each of these providers processes personal information in accordance with its own terms and privacy practices.

6.2 Compliance, Safety, and Enforcement

We may disclose personal information when we believe in good faith that disclosure is required or permitted by law, regulation, legal process, or governmental request, including to respond to subpoenas or court orders, to enforce our Terms and Conditions, to investigate fraud or abuse, or to protect the rights, property, safety, or security of David Allen Weinstock, the Site, our users, or the public.

6.3 Business Transfers

If we are involved in a merger, acquisition, financing, reorganization, sale of assets, dissolution, or similar transaction, personal information may be transferred to a successor or affiliated entity as part of that transaction, subject to commercially reasonable confidentiality protections.

6.4 With Your Direction or Consent

We may share personal information with other parties at your direction or with your consent.

7. International Data Transfers

We are located in the United States, and the Site is hosted and operated from the United States. If you access the Site from outside the United States, your personal information may be transferred to, processed in, and stored in the United States and other countries where our service providers operate. These countries may have data protection laws different from, and in some cases less protective than, those of your country.

Where personal information is transferred from the European Economic Area, the United Kingdom, or Switzerland to a country that has not received an adequacy decision from the relevant authority, we rely on appropriate safeguards, including the European Commission’s Standard Contractual Clauses, the UK International Data Transfer Addendum, or equivalent mechanisms, as implemented by our service providers. You may contact us using the details in the Contact section to request information about the safeguards in place.

8. Cookies and Tracking Technologies

The Site uses cookies, pixels, local storage, and similar technologies to operate the Site, remember your preferences, analyze traffic, and improve performance. Cookies are small text files placed on your device by your browser when you visit a website.

We use the following categories of cookies and similar technologies:

  • Strictly necessary cookies, which are required for the Site to function and cannot be switched off;

  • Functional cookies, which remember your preferences and improve usability;

  • Analytics cookies, which help us understand how visitors use the Site; these are provided by Squarespace Analytics.

Where required by applicable law, we will request your consent before placing non-essential cookies on your device through a cookie consent banner. You can manage or withdraw cookie consent at any time through the cookie controls provided on the Site or through your browser settings. Most browsers allow you to block or delete cookies; however, doing so may affect the functionality and your experience of the Site.

Some browsers offer a "Do Not Track" signal. Because there is no industry-standard interpretation of these signals, the Site does not currently respond to them. We honor opt-out preference signals (such as the Global Privacy Control) where required by applicable law.

9. Data Retention

We retain personal information only for as long as necessary to fulfill the purposes for which it was collected, including to provide the Site and any paid offerings, to comply with legal, accounting, or reporting obligations, to resolve disputes, and to enforce our agreements. Specific retention periods include:

  • Newsletter and account information: retained for as long as you remain subscribed or your account is active, and for a reasonable period thereafter for recordkeeping;

  • Inquiry and contact-form information: retained for as long as necessary to respond and follow up, and for a reasonable period thereafter;

  • Booking and meeting records: retained for a reasonable period to maintain a record of engagements and to follow up;

  • Transaction and tax records: retained as required to comply with applicable financial, tax, and regulatory recordkeeping obligations;

  • Analytics data: retained in accordance with our analytics provider’s standard practices, generally in aggregate or de-identified form.

When personal information is no longer required, we will delete or anonymize it, unless retention is required by law or is necessary for the establishment, exercise, or defense of legal claims.

10. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, loss, and destruction. Where personal information is processed by service providers, those providers are contractually obligated to implement appropriate security measures. However, no method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. You are responsible for safeguarding any account credentials you use to access the Site.

11. Your Rights and Choices

Depending on your location and applicable law, you may have some or all of the following rights with respect to your personal information:

  • Access: the right to request access to the personal information we hold about you and to receive a copy of it;

  • Correction: the right to request correction of inaccurate or incomplete personal information;

  • Deletion or erasure: the right to request deletion of your personal information, subject to certain exceptions;

  • Restriction: the right to request that we restrict the processing of your personal information in certain circumstances;

  • Portability: the right to receive your personal information in a structured, commonly used, and machine-readable format and to have it transmitted to another controller, where technically feasible;

  • Objection: the right to object to processing based on legitimate interests, including processing for direct marketing purposes;

  • Withdrawal of consent: the right to withdraw consent at any time, where processing is based on consent, without affecting the lawfulness of processing prior to withdrawal;

  • Automated decision-making: the right not to be subject to a decision based solely on automated processing that produces legal or similarly significant effects. We do not currently engage in such automated decision-making;

  • Complaint: the right to lodge a complaint with a supervisory authority in your jurisdiction.

You may unsubscribe from marketing communications at any time by following the unsubscribe link included in those communications. You may also exercise any of the rights above by contacting us using the details in the Contact section. We will respond within the timeframe required by applicable law and may need to verify your identity before fulfilling your request.

12. Notice to U.S. State Residents

If you are a resident of California, Colorado, Connecticut, Virginia, Utah, or another U.S. state with a comprehensive consumer privacy law, you may have additional rights under that law, including the rights to know, access, correct, delete, and obtain a copy of your personal information, the right to opt out of the sale or sharing of personal information for cross-context behavioral advertising or targeted advertising, and the right to limit the use and disclosure of sensitive personal information. We do not sell personal information, we do not share personal information for cross-context behavioral advertising, and we do not knowingly process the sensitive personal information of consumers in a manner that triggers the right to limit.

To exercise your rights, please contact us at hello@davidweinstock.com. You may designate an authorized agent to make a request on your behalf, subject to verification. We will not discriminate against you for exercising any of your rights.

California residents may also request information regarding the disclosure of personal information to third parties for direct marketing purposes under California Civil Code Section 1798.83. We do not disclose personal information to third parties for their direct marketing purposes.

13. Children’s Privacy

The Site is intended for individuals who are at least eighteen (18) years of age. We do not knowingly collect personal information from children under 18, and the Site is not directed to children. If we become aware that we have collected personal information from a child under 18 without verified parental consent, we will take steps to delete that information promptly. If you are a parent or guardian and believe a child has provided personal information through the Site, please contact us using the details in the Contact section.

14. Third-Party Links and Services

The Site may contain links to, or be integrated with, third-party websites, applications, and platforms, including Stripe, Calendly, Squarespace, social media platforms, and other tools. This Privacy Policy applies only to the Site. We are not responsible for the privacy practices, content, or security of any third-party website or service. We encourage you to review the privacy policies of any third party before providing personal information to that party.

15. Marketing Communications

If you have subscribed to our newsletter or otherwise consented to receive marketing communications, we may send you content updates, newsletters, and information about new offerings. You may unsubscribe at any time by clicking the unsubscribe link in any marketing email or by contacting us. Even after you opt out of marketing communications, we may continue to send you transactional and administrative messages that are necessary for the operation of the Site or your account.

16. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or for other operational reasons. When we make material changes, we will update the Effective Date at the top of this page and, where required by applicable law, provide additional notice. We encourage you to review this Privacy Policy periodically to stay informed about how we handle your personal information.
